Probate

Probate is the legal process of administering the estate of a deceased person by resolving all claims and distributing the deceased person’s property.  Ms. Goldberg assists clients in the probate of their loved one’s estate, whether or not a will exists at the time of death.

Estate Planning

Estate planning is the process of anticipating and arranging for the disposal of an estate. Ms. Goldberg assists clients with preparation of wills, trusts, powers of attorney (durable financial power of attorney and durable medical power of attorney), as well as directives to physicians, designation of guardians and other planning documents.

Elder Law

Elder law involves counseling on the legal rights and issues concerning seniors.
Ms. Goldberg assists clients with services which include powers of attorney, guardianship, conservatorship, estate planning, and wills.

Guardianships

Guardianship is a court supervised proceeding where a guardian is appointed or selected by the court to act on behalf of an incapacitated person or a minor. Ms. Goldberg is an expert in assisting many parents obtain guardianship of their special needs son or daughter at 18 years of age or older.  The guardianship process can begin up to six months prior to the child’s 18th birthday.  Ms. Goldberg also assists clients in obtaining guardianship of an elderly parent.

Special Needs Planning

Special Needs Planning addresses the legal needs of families that have a loved one with a disability.  Experienced and knowledgeable, Ms. Goldberg specializes in assisting clients to plan for the future and security of a loved one with a disability, through guidance of governmental benefits (such as Medicaid and SSI) and development of a special needs trust (a specific type of trust that allows families to provide for the child or adult while maintaining eligibility for government benefits).

Government Benefits

Children and adults with disabilities can receive financial, medical and housing assistance from benefits available through state and federal government programs. Ms. Goldberg assists families in obtaining these benefits for their loved one.

Family Law

A family with a special needs child or disabled spouse that is going through a divorce or post-divorce must plan properly to maintain eligibility for government benefits. Ms. Goldberg assists families and family law attorneys in these matters.
